Airsquare offers it's services on the following terms and conditions. When you sign up and use Airsquare services, you agree to these terms and conditions. We may update them without notification, so check them regularly.
In the following, 'you' refers to the user/client of Airsquare, and 'Airsquare services' refers to the Airsquare tools which allow you to create and host your website.
Copyright
You agree that Airsquare services contain copyrighted material; Airsquare services are the intellectual proprietary property of Airsquare. Their use is controlled by these terms and conditions.
You agree that you will not attempt to discover, redistribute, reproduce or use any programming code that Airsquare services use.
You agree that if you violate the terms of this agreement, you will be held accountable by appropriate law.
You agree that you have the right to use any trademarks or copyrights that you are using within Airsquare services.
Airsquare Terms of Use
To sign up and use the Airsquare services, you certify that you are over 18 years of age.
You agree that you will use Airsquare services to create a legitimate online presence for lawful purposes only.
Use of Airsquare services requires you to have a good level of knowledge in the use of the Internet.
Airsquare reserves the right to immediately turn off your website if it's content is deemed inappropriate, as judged by Airsquare; content that is illegal, violent, sexually explicit, obscene, pornographic, inflammatory, abusive, threatening, misleading, slanderous or libelous cannot be uploaded, published, distributed or 'linked to' on any sites which are using the Airsquare services. When a website is turned off due to an infringement of these terms of use, no refund of fees will be given.
Airsquare reserves the right to remove any messages on the interactive areas of your site, if they are deemed by Airsquare to be inappropriate.
Airsquare assumes no liability for any content, legality, business, links to third party sites, quality or security associated with your website.
Airsquare accepts no responsibility for loss of data: you are responsible for your own backups.
You cannot use Airsquare services to distribute spam (junk mail) or to collect personal information about people without their consent.
Airsquare does not allow you to use the service as a file repository only and will turn off accounts where this is deemed (by Airsquare) to be occurring.
You cannot access the service through an automated device or computational machine; the use of robots or any other computer code that attempts to data-mine the service is not allowed.
Airsquare reserves the right to refuse to do business with you.
You cannot lease Airsquare services to anyone else.
Domains and sub-domains
Domains are your responsibility.
Airsquare provides free use of sub-domains (i.e. yoursite.airsquare.com) to allow you to host your website. You agree that Airsquare owns and retains any rights to all Airsquare sub-domains.
Content Policy
You are responsible for adding content to your site and for editing this content.
Airsquare takes no responsibility for actual content posted to your website while you are using Airsquare services. If any legal action arises from your actions, or from the content of your website, you agree to cover any associated legal fees.
Fees and payment
Airsquare offers a 14-day free trial period. After 14 days, your website will be suspended and you can decide to 'opt out' or opt for a paid plan. You have 30 days to decide before your trial site will be permanently deleted.
Fees will be only be applied when/if you sign up for a month-by-month paid plan.
Paid plans are a per-monthly contract agreement with Airsquare. The fee for each contract is stated in Airsquare's pricing plans. Any fees for additional services required, e.g. bespoke design, copy writing etc. will be as agreed between you and Airsquare.
Fees will be paid by you, by credit card, direct credit or bank transfer, within seven days of your invoice being received each month.
You can opt to upgrade or downgrade to any other paid plan that Airsquare is currently offering. However, in the event of a contract downgrade or upgrade, your contract fees can only be changed in the next billing cycle. No discount/extra fees will be applied before the next billing cycle. Airsquare will never issue cash refunds for contract cancellation. If you have a query about your account fees, please contact us immediately.
If you fail to pay your monthly fees within seven days of the agreed payment date, your account will be suspended until payment has been made. If you continue not to pay, your account will be closed and unpaid debts will be reported to appropriate credit reporting agencies.
Taxes
Airsquare is not liable for any taxes or fees owing, for any purchases that you have made or services used by you, through the Airsquare services.
Any applicable taxes that Airsquare is obligated to charge, will be added to your monthly invoice.
Contract cancellation policy
Each month, on the anniversary of the date when you signed up for your paid plan, the contract will automatically be renewed and will continue to be paid by you, until it is cancelled by you, in writing, via helpdesk@airsquare.com. Contract cancellation must be completed at least 3 days prior to the end of the contract term. Airsquare will never issue cash refunds for part-unused months after contract cancellation.
Storage
You agree that Airsquare has the right to change limits on use and storage at any time.
License
While you are logged in to your Airsquare account, you have a non-transferable, temporary licence to access and use Airsquare services, in order to create a website that is hosted on this site and in accordance with the terms and conditions stated in this agreement.
You are not allowed to store the software or documentation on any device or to copy any of this information for your own use or resale.
Any improper use of the Airsquare services will result in the cancellation of the temporary licence granted.
As an Airsquare user, no licence to intellectual property rights has been granted to you.
Your Privacy
All personal information that you provide in order to use Airsquare services, must be accurate and current and will be controlled by the Airsquare Privacy Policy. By using Airsquare services you understand and accept the Airsquare privacy policy. You accept all risk posed by the submission of this personal data to Airsquare.
To create a site using Airsquare services, you must create a User name and password which can only be used by you. You are therefore responsible for all activities that occur under your User name and must keep your password secure.
You must also have a valid email address on file, in order to use Airsquare services. If you do not, your account will be closed.
You agree that Airsquare has the right to monitor the content of your user account.
The Airsquare servers may not be located in your country; therefore, you agree to the personal information which Airsquare collects about you being transferred, in order for it to be stored on Airsquare servers.
Airsquare reserves the right to provide any information necessary, if required by law, to protect itself, other users or the public and to prevent fraud or security issues.
General Privacy
All emails and messages sent via Airsquare services should accurately identify the sender.
Limited Liability
Airsquare takes no responsibility for and will not be liable for, damages caused or allegedly caused, to your website or business, resulting from interruptions to the service, acts of God, theft, deletion, communication failures or unauthorised access to Airsquare files.
Limited Warranty
Airsquare does not make any warranty about the results that can and will be obtained by using the Airsquare services to create your website.
Airsquare services are provided "as is" and you use the services at your own risk. The quality of your website is your responsibility.
Airsquare cannot and does not guarantee constant availability of the Web Server. Airsquare takes no responsibility or liability for your Website being unavailable due to the Web Server being down. We will endeavour to inform you of such occurrences and it is our priority to offer you as much uninterrupted service as we can.
Changes to this document
Airsquare can change their services and associated rates and will inform you of these changes within 30 days.
Cancellation of your account
Either you or Airsquare can cancel this contract by giving three days written notice.
Airsquare can also cancel this contract without notice, if these terms and conditions are breached.
When the contract ends, for whatever reason, all information and data associated with your account will be deleted immediately.
